Syed Sohbat Shah v. Muhammad Khan,
CLC 2010 1527 · Balochistan High Court
This case involved a long-running property dispute in Noushki, Balochistan, over agricultural land described by certain khasra and khatooni numbers and specific boundaries. The original plaintiffs (later petitioners) claimed the land was their ancestral property, in possession of a tenant, and sought declaration of ownership, an injunction, and recovery of possession. During the trial, a Local Commissioner (the Tehsildar) inspected the site with consent of both parties and submitted a report. Based on that report, and with the consent of both sides, the trial court passed a decree in the plaintiffs' favor without objection to the report.
Later, when the decree-holders tried to execute the decree and obtain physical possession of land they claimed fell within the boundaries mentioned in their plaint, the executing courts refused. Both the trial court and the appellate court found that the decree did not actually cover the additional land being claimed, and that the decree-holders were already in possession of the specific plots awarded to them. The courts even warned them against filing frivolous litigation.
The High Court upheld these findings, ruling that a court executing a decree cannot go beyond or reinterpret what the decree actually says, and that parties who consented to a decree based on an inspection report cannot later go back on that agreement to claim more land than was granted. The revision petition was dismissed.
The case matters because it reinforces two settled principles: consent decrees bind the parties who agreed to them, and execution proceedings are not an opportunity to expand or relitigate the scope of what was originally decreed.
