Muhammad Rasool v. Abdul Ghafoor,

CLC 2010 1507 · Balochistan High Court

This case is about a property dispute in Quetta over a small plot of land. Abdul Ghafoor (the plaintiff) claimed he was the rightful owner of the land but was forcibly deprived of possession by Muhammad Rasool and other defendants in 1998. He sued for a declaration of ownership, recovery of possession, and an injunction stopping the defendants from transferring or altering the property. The defendants argued that the plaintiff had actually sold the property to one of them, with part payment made and possession handed over, and they also raised technical objections about the suit's valuation, lack of a valid legal cause of action, and improper joinder of parties.

Both the trial court and the first appellate court ruled in favor of the plaintiff, rejecting the defendants' claims and technical objections. The defendants then filed a revision petition before the Balochistan High Court, arguing that evidence had been ignored and that the judgments were flawed.

The High Court dismissed the petition, upholding the lower courts' decisions. It found that the defendants failed to identify any specific evidence that had been overlooked, could not prove the alleged sale, and had no real basis for challenging the valuation of the suit. The court reaffirmed that a plaintiff's stated valuation is presumed correct unless disproved.

This case illustrates how courts handle disputes over property ownership and possession, and reinforces that vague, unsubstantiated objections cannot overturn concurrent findings of lower courts.
