Dr. Liaquat Ali v. Ashfaq Ahmed,

CLC 2010 1471 · Balochistan High Court

This case involved a dispute over whether a suit for damages had been filed with proper legal authority. Dr. Liaquat Ali had earlier been sued for Rs. 25,000 by Ashfaq Ahmed, a case that was dismissed. Following this, a suit seeking Rs. 10,000,000 in damages was filed against Ashfaq Ahmed, purportedly on Liaquat Ali's behalf, through a person named Asghar Ali who claimed to be his attorney. Ashfaq Ahmed challenged this, arguing that Asghar Ali had no valid power of attorney authorizing him to file the damages suit. The trial court agreed, dismissed the suit, imposed costs on Asghar Ali, and directed that a criminal case be lodged against him for acting fraudulently without authority.

Liaquat Ali then filed a revision petition in the Balochistan High Court challenging that dismissal. However, the High Court noticed that this revision petition itself was filed by the same Asghar Ali, again claiming to act as attorney.
