Bibi Shah Gul v. Saadia,
CLC 2010 1440 · Balochistan High Court
This case involved a family property dispute in Quetta. Saadia sued relatives of her late father, Noor Muhammad, claiming her rightful inheritance share after they allegedly got his property mutated (transferred) in their own names, cutting her out. The courts found she was indeed his legal heir and entitled to half share of a specific property, while ruling that a will supposedly favoring another relative was forged. This decision went through several rounds of appeals, including to the Balochistan High Court and Supreme Court, which ultimately confirmed her half-share entitlement.
Once the decree was final, Saadia applied to have it executed, meaning the property was actually to be divided and transferred according to the court's ruling. One of the other heirs, Bibi Shah Gul, objected to how execution was carried out, arguing the executing court exceeded the decree by allowing Saadia to receive more valuable land than her fair share, and that her own portion had been ignored.
The High Court dismissed her revision petition. It held that under Section 47 of the Civil Procedure Code, disputes about executing a decree must be resolved by the executing court itself, not through a fresh lawsuit. Since Bibi Shah Gul had failed to object earlier despite having knowledge of proceedings, and could not clearly show any error in the property measurements or mutation, her objections had no merit. The lower courts' orders executing the decree were upheld, reaffirming that execution courts have authority to settle such disputes directly.
