National Bank of Pakistan v. WASA,
CLC 2010 1343 · Balochistan High Court
This case from the Balochistan High Court dealt with a procedural dispute involving the National Bank of Pakistan and WASA (Water and Sanitation Agency). The bank had earlier filed a civil appeal against orders of a Senior Civil Judge in Quetta, but that appeal was dismissed in 2008 because the bank failed to pursue it properly (dismissed "in default"). The bank then tried to get the appeal restored, but did so about a year late and without asking the court to excuse the delay. This restoration request was also dismissed in July 2009.
Instead of accepting that outcome, the bank waited over eight months and then filed a "review application," asking the High Court to reconsider and set aside its own order. The bank argued that a longer limitation period (three years) should have applied to its case.
The High Court rejected this review application. It explained that under the law, a review can only succeed if there is a new and important piece of evidence that was not earlier available, or if there is an obvious mistake or error visible on the face of the original order. Neither condition was met here—the bank was essentially just repeating old arguments rather than pointing to any genuine error or new fact.
The judgment matters because it reinforces strict limits on when courts can revisit their own decisions, preventing review proceedings from being misused as a backdoor appeal.
