Abdul Nasir v. Bibi Janatora,

CLC 2010 1293 · Balochistan High Court

This case involved a dispute over agricultural land in Pishin, Balochistan. The plaintiffs claimed to own three-quarters of a property and argued that the remaining one-quarter share, originally belonging to two individuals named Sufi and Mandak, should pass to them because Sufi and Mandak had died without children, making the plaintiffs their closest surviving relatives. The defendants disputed this, claiming the land had legitimately passed through inheritance to a grandson and then to them through official mutation entries in the land records. The trial court and first appellate court both dismissed the plaintiffs' suit.

The High Court found that neither side could actually prove their claimed relationship to the deceased original owners. However, it agreed that Sufi and Mandak likely died without children, since the land records showed no heirs were ever properly recorded after their deaths, and the inheritance mutations were only entered nearly a century later without any explanation of who requested them. This meant the mutation entries were fraudulent.

Despite finding fraud, the lower courts had refused to cancel the mutations because the plaintiffs failed to prove their own title. The High Court ruled this reasoning was flawed: fraudulent entries should be struck down regardless of whether the plaintiffs proved ownership. It restored the original ownership entries in the names of Sufi and Mandak and directed the revenue authorities to reexamine the matter from scratch and proceed according to law. The plaintiffs, however, were not granted ownership themselves, since they failed to establish their own title.
