Nasir Hayat v. Qamar Raza Rizvi,

CLC 2010 1261 · Balochistan High Court

This case involved a property dispute in Quetta. Nasir Hayat had won a court decree in October 2002 ordering the other party, Qamar Raza Rizvi, either to pay him a large sum of money under three agreements, or, failing that, to transfer a house to him along with possession. When Hayat later tried to have this decree enforced through an execution application, the trial court dismissed his application in August 2007, ruling that it was filed too late, beyond the legal time limit.

Hayat appealed, arguing that he had actually filed an earlier execution application within the proper time limit back in 2004, which was dismissed only because no one appeared to pursue it, and that his 2006 application should be treated as a continuation, not a fresh late filing. He also argued that since the decree was based on the other side's admission of his claims, he shouldn't be denied justice on a technical point about deadlines.

The Balochistan High Court rejected the appeal. Despite being given multiple opportunities, Hayat could not produce reliable proof of the earlier 2004 application, and the document he provided contradicted the court's own record of proceedings. He also failed to show any fraud, misrepresentation, or valid reason justifying the delay. The court held that without such proof, the six-year limitation period for executing a decree could not be extended, and upheld the dismissal.

The case highlights how strictly courts enforce time limits for executing decrees, even when the underlying claim was never disputed.
