Shahnaz Parveen v. Abdul Aziz,

CLC 2010 1250 · Balochistan High Court

This case involved a dispute over a house in Quetta. The respondents (plaintiffs) sued the predecessor of the petitioners, claiming that their family had purchased the house in 1939 and later allowed a man named Rahim Bakhsh Barfi to occupy two rooms as a licensee under an agreement. They alleged he later violated the terms of that arrangement and, after a earlier court petition was withdrawn, colluded with revenue department staff to fraudulently change property records in his own favor. They asked the court to cancel the 1982 agreement, declare their ownership, and restore possession of the house to them.

The trial court and, on appeal, the District Court both ruled in favor of the plaintiffs, relying on documentary evidence including the 1982 agreement (showing the occupant was only a licensee) and a 1939 registered sale deed proving the plaintiffs' grandfather had bought the property. The defendants then challenged these decisions before the Balochistan High Court, arguing the suit was time-barred and that the 1982 agreement was fraudulent.

The High Court dismissed the challenge. It found the limitation argument baseless, since the cause of action arose only after the revenue records were fraudulently altered, and the suit was filed well within time. It held that concurrent factual findings by lower courts cannot be disturbed in revision unless they involve jurisdictional error or serious illegality, which was not shown here. The case reaffirms the limited scope of revisional courts to interfere with settled factual findings of lower courts.
