PLJ 2018 Islamabad 224 (DB)

CLC 1383). Learned counsel for the appellants prayed for the impugne · Islamabad High Court

This case involved a landlord-tenant dispute in Islamabad. The landlords (Respondents 2-5) and tenants (the appellants, Ch. Naseer Ahmed and his wife) had co-owned a plot of land, part of which was leased under a 2006 agreement for ten years. When the lease expired, the landlords filed for the tenants' eviction before the Rent Controller under the Islamabad Rent Restriction Ordinance, 2001. The tenants tried to block these proceedings by invoking an arbitration clause in the lease agreement, applying under Section 34 of the Arbitration Act, 1940 to have the eviction case stayed and sent to arbitration instead.

The Rent Controller rejected this request, and a single judge of the Islamabad High Court upheld that decision. The tenants then appealed to a two-judge bench (Intra Court Appeal).

The High Court dismissed the appeal. It ruled that although parties are generally free to agree to arbitration for contractual disputes, when a special law like the Rent Restriction Ordinance specifically governs an area—here, tenant eviction—that special law takes priority over general arbitration agreements. Eviction matters must go through the Rent Controller, not arbitration, even if the lease contains an arbitration clause. The court upheld the earlier rulings, confirming that the Rent Controller alone had jurisdiction over the eviction case.

This judgment matters because it clarifies that arbitration clauses cannot be used to escape specialized legal processes designed to protect

رینٹ کنٹرولر نے یہ درخواست مسترد کر دی، اور اسلام آباد ہائی کورٹ کے ایک رکنی بینچ نے اس فیصلے کو برقرار رکھ
