Judgment must discuss each and every issue in evidence
CLC 1274 SUPREME-COURT-AZAD-KASHMIR · Azad Jammu & Kashmir High Court
This case involved a dispute between Allah Ditta and Muhammad Sharif over a suit for possession of property. The trial court and the first appellate court had both dismissed the suit. The matter then went to the High Court on second appeal, which sent the case back (remanded it) to the appellate court, directing it to decide the case afresh. The losing party challenged this remand before the Supreme Court of Azad Kashmir.
The Supreme Court upheld the High Court's decision to remand the case. It explained that under Order XLI, Rule 31 of the Civil Procedure Code, an appellate court is legally required to properly discuss the evidence and record findings on each issue raised in a case. As a court of facts, the appellate court cannot simply give a short, bare-bones ruling without engaging with the evidence - unless deciding just one or two key issues is enough on its own to resolve the whole case.
In this particular case, the appellate court had only addressed the question of limitation but failed to decide whether the suit was barred under Order II, Rule 2 of the CPC (a rule about splitting claims), and had not even framed that issue properly. Since this unresolved issue was crucial to deciding the appeal, the appellate court's brief, incomplete judgment was inadequate.
This ruling matters because it reinforces that courts must give reasoned, issue-by-issue judgments, ensuring fairness and transparency, rather than deciding cases in a cursory or incomplete manner.
