Sajjad Ali V/S Province of Sindh & others Sindh High Court Bench: Hon'ble Mr. Justice Adnan-ul-Karim Memon(Author), Hon'ble Mr. Justice Adnan Iqbal Chaudhry Accordingly, while the petitioner cannot claim regularization as a matter of right in the absence of statutory sanction. However the issue is related to the representation which has already been decided which is not open under Article 199 of the Constitution for the reasons discussed supra. 11. Resultantly, the petition for regularization of service is not maintainable as his representation as directed by this Court has been decided on the aforesaid analogy; therefore, he cannot reopen the case under Article 199 of the Constitution. 12. For the foregoing reasons, this petition is not maintainable under Article 199 of the Constitution and is dismissed in limine.
